Welcome to Smart Waste Management System (SWMS) Kathmandu. By using our services, you agree to comply with and be bound by the following terms and conditions.
1. Acceptance of Terms
By accessing or using the SWMS Kathmandu platform, mobile applications, or any associated services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our services.
2. User Registration and Account
- Users must provide accurate and complete information during registration, including a valid email address, phone number, and residential address within Kathmandu Valley.
- All user registrations are subject to verification and approval by our administrative team.
- Phone numbers are verified by our admin team to ensure authenticity and prevent fraudulent accounts.
- Users are responsible for maintaining the confidentiality of their account credentials.
- You must notify us immediately of any unauthorized use of your account.
- One account per household/resident is permitted.
3. Waste Collection Services
- Waste collection schedules are subject to change based on operational requirements and weather conditions.
- Users must segregate waste into appropriate categories (organic, recyclable, hazardous) as per municipality guidelines.
- Hazardous waste requires special collection requests and may incur additional charges.
- Waste must be placed at designated collection points before the scheduled collection time.
- SWMS Kathmandu reserves the right to refuse collection of improperly segregated or prohibited materials.
4. Payments and Fees
- Users agree to pay all applicable fees for waste collection services as per the current rate schedule.
- Payments can be made through approved payment gateways (Khalti, eSewa) or designated collection centers.
- All payments are non-refundable unless otherwise specified.
- Failure to pay may result in suspension of services.
- Service fees may be revised periodically with prior notice to users.
5. User Responsibilities
- Follow all waste segregation guidelines provided by SWMS Kathmandu.
- Ensure waste containers are properly secured to prevent spillage.
- Do not dispose of prohibited items including medical waste, construction debris (without prior arrangement), or hazardous materials without proper notification.
- Treat waste collection personnel with respect and courtesy.
- Report any issues or complaints through the official complaint system.
6. Smart Dustbin Usage
- Public smart dustbins are provided for community use and must not be misused or vandalized.
- Only appropriate waste should be deposited in smart dustbins.
- Users are prohibited from tampering with IoT sensors or other equipment.
- Report any damaged or malfunctioning dustbins through the app.
7. Data Collection and Privacy
Your privacy is important to us. Please refer to our Privacy Policy for information on how we collect, use, and protect your personal data.
8. Prohibited Activities
Users are prohibited from:
- Providing false or misleading information during registration.
- Using the platform for any unlawful purpose.
- Attempting to gain unauthorized access to our systems.
- Interfering with the proper functioning of the service.
- Submitting false complaints or requests.
- Sharing account credentials with others.
9. Account Termination
- SWMS Kathmandu reserves the right to suspend or terminate accounts that violate these terms.
- Users may request account deletion by contacting our support team.
- Upon termination, all pending service requests will be cancelled.
- Outstanding payments remain due even after account termination.
10. Limitation of Liability
- SWMS Kathmandu shall not be liable for service interruptions due to natural disasters, strikes, or circumstances beyond our control.
- We are not responsible for any damages arising from improper waste handling by users.
- Our liability is limited to the fees paid for the specific service in question.
11. Changes to Terms
SWMS Kathmandu reserves the right to modify these terms at any time. Users will be notified of significant changes via email or in-app notifications. Continued use of services after changes constitutes acceptance of the modified terms.
12. Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of Nepal. Any disputes shall be subject to the exclusive jurisdiction of the courts of Kathmandu.
